INTERNAL REPORTING SYSTEM

What is the Internal Reporting System?

It is a system that allows people to inform Azkuna Zentroa of any irregularities that come to their attention in the course of their employment or professional relationship with the organisation. The facts can subsequently be investigated whilst the informant’s identity is protected.

Applicable law

Law 2/2023 of 20 February on the protection of persons who report regulatory infringements and the fight against corruption.

Purpose of this regulation

To protect individuals who report any of the acts or omissions referenced in Article 2 of Law 2/2023 of 20 February against reprisals.

To reinforce the reporting culture and the integrity infrastructure of an organisation, and promote culture of communication and information as a mechanism to prevent and detect threats to the public interest.

Internal Reporting System

Implemented by the organisation’s governing body.

The system meets the requirements established in article 5 of the Law including the following, inter alia:

  • It allows any person referenced in article 3 of the Law to report the infringements stated in article 2 thereof. The people who have an employment or professional relationship with Azkuna Zentroa include:
    • Azkuna Zentroa staff.
    • Self-employed individuals.
    • Shareholders or members of an organisation’s administrative, management or supervisory body.
    • Volunteers, interns and trainees.
    • People who work for contractors, subcontractors and suppliers of Azkuna Zentroa.
  • Such person may report:
    • Serious and very serious criminal and administrative offences.
    • Infringements caused by actions that contravene European Union legislation in a way that can affect its financial interests or internal market.
  • It is securely designed, implemented and managed in a way that keeps the identity of the informant and the investigation of the events confidential, and protects personal data.
  • It must be possible to submit the report verbally and/or in writing.
  • The system includes the following features:
    • INTERNAL REPORTING CHANNEL. Reports are submitted anonymously and subsequent investigations are confidential. Complaints/reports can be submitted through the following channels:

How to report

Before making a report through any of the channels provided, and in order to avoid omissions or inaccuracies in the information, we recommend that you gather as much information as possible. Types of information to provide about the event:

  • Date, place and time.
  • The person or persons involved (who allegedly committed the offence).
  • Potential witnesses.
  • A detailed description of the events.
  • Evidence of what happened.

Purpose To record and process reports submitted through the Internal Reporting System.
Legal basis Article 6.1 c) and 6.1 e) of GDPR:
Fulfilment of legal obligations arising from the regulations governing the protection of individuals who report infringements of the law and the fight against corruption. Fulfilment of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Disclosure The data necessary to process the information/report will be disclosed to third parties in accordance with the law. There will be no international data transfers.
Rights Data subjects have the right to:

  • Access, rectify, erase, restrict or object processing by sending a letter to the data processor, enclosing proof of identity; or to the Bilbao City Council Citizens' Advice Points;
  • File a complaint with the Basque Data Protection Agency.
